Thomas Kerr Tom Kerr is licensed in Texas and admitted to practice before all state courts, the federal courts for the Eastern, Western, and Southern districts of Texas, and the United States Fifth Circuit Court of Appeals. Prior to entering the practice of law, Tom obtained an M.B.A. from the University of Texas and spent several years as a management consultant in the 'Big 6' rising to the level of Experienced Manager in the Merger and Integration Practice for Arthur Andersen and as Manager of Business Services for Dell Computer Corporation. His diverse experience provides insight to his clients' business and legal concerns making him a more effective advocate. Tom has served as an expert in business related litigation but primarily focuses on representation of corporate entities in commercial litigation and transactional matters. Tom has handled complex matters for all sizes and types of businesses. Aside from the practice of law, Tom is actively involved in his community, and is currently serving as the Vice President of a youth oriented non-profit organization, as volunteer coach in youth athletics, as an election official and recently completed a term as President of the Augusta Pines Homeowners' Association.

    • $25,000,000+ sale of drilling rigs to Indian entity;
    • Negotiated terms for multi-year Master Services Agreement for aviation services;
    • Multiple domestic and international software and software services agreements


Case: Represented a vendor in a complex construction defect and product liability suit concerning components for a steel framing system utilized in the construction of homes.
Result: Obtained summary judgment prior to trial.

Case: Represented a radiologist employed as department chair by the University of Texas Health Sciences Center in a medical malpractice suit involving allegations of failure to diagnose and treat a minor child with significant long term medical issues.
Result: Settled with no finding of fault against represented client

Case: Defended a drilling contractor in a wrongful death suit resulting from failed drilling operations and the pressurized ejection of the pipe string in case involving complex oilfield indemnification provisions.
Result: Obtained indemnification for client pursuant to oilfield services contract and settled the matter prior to trial.

Case: Represented an independent producer of oil and gas in a multi-million dollar breach of contract case related to failure to take gas ratably from a producing field.
Result: Obtained jury verdict in favor of client for damages and attorneys' fees.

Case: Represented former employee in dispute related to enforcement of employment agreement, wrongful termination and unpaid commissions.
Result: Jury verdict in favor of client for unpaid commissions and attorney's fees.
